1. What is a Trademark Filing Basis?
Simply put, a trademark filing basis informs the USPTO of the current status of a mark in relation to the market. It categorizes the applications based on how they are being (or will be) used. This becomes a determinative factor for the USPTO in assessing the legitimacy of a mark's claim to protection.
2. Types of Filing Basis
The USPTO recognizes multiple filing bases, each catering to a specific scenario:
Already in the Market?
1(a) Use in Commerce: This is for trademarks already in use in commerce within the United States. Applicants must provide proof of use, including your products or services, and instances of its active sale, often through your website or advertisements.
Launching Soon?
1(b) Intent to Use: Perfect for those setting up their business and foresee using a particular trademark soon, but haven't started selling yet. It's a way to reserve your brand name. Once approved, the applicant will have to eventually prove their usage to retain the registration.
Expanding Internationally?
44(d) Foreign Application: If the applicant has a pending trademark application in their home country and wishes to file in the U.S., they can use this basis. It provides a priority claim based on the foreign filing date.
44(e) Foreign Registration: For those with a trademark already registered in another country, this basis lets them file in the U.S. using that registration as proof.
3. Importance of Selecting the Correct Basis
While the initial application does not necessarily require an applicant to select a filing basis, it is recommended to do so. Selecting the correct basis:
Reduces Delays: Accurate selection speeds up the processing time, as the USPTO does not need to request additional information or clarifications.
Avoids Additional Costs: Changing the basis later or addressing official actions may result in additional fees.
Simplifies Registration: Correctly aligning the mark's status with its filing basis ensures a straightforward registration process.
4. Challenges & Considerations
Applicants should be aware that if they select the "Intent to Use" basis and fail to commence actual use within a stipulated time, they risk abandonment of the application. Also, if a mark is filed under a foreign application or registration basis, it's vital that the foreign details align precisely with the U.S. application to avoid discrepancies.
